On February, 24 was held a regular meeting of the Legal Committee of the URE Club. During the first meeting Committee members discussed the Draft Law on regulating of land area:
- Draft Law of Ukraine «On Land Market»;
- Draft Law of Ukraine «On State Land Cadastre».
The adoption of these laws is a prerequisite for lifting the moratorium on the alienation of agricultural land, so the discussion of the projects led to a keen interest of the members of the Committee of the URE Club.
During the discussion, Vladislav Kysil, chairman of the Legal Committee of the URE Club, partner of law company KPD Consulting, said: «Draft Law on the land, prepared by the State Committee of land, introduces severe restrictions on those who have the opportunity to acquire ownership of agricultural land for marketable agricultural production. Such persons are solely citizens of Ukraine and the State or local authorities.
Thus, agricultural enterprises and other entities will not be able to buy plots of land intended for commercial agricultural production. On the formation of a full-fledged market of agricultural land in such situation cannot speak».
The meeting noted that a number of provisions of the bill due to their insufficient articulating impose additional unreasonable restrictions in circulation and use of agricultural land for all uses. Based on discussions by the Committee of the URE Club were adopted proposals on improving the Draft Law.
During the meeting was also reviewed the Draft Law of Ukraine «On State Land Cadastre». Following the discussion, participants commented that the Draft Law proposes to introduce an additional registration system in the field of real estate - the state registration of land in the land registry, in some cases, such registration duplicates the functions of the state registration of rights to land or is a prerequisite for the latter. «Empowerment of cadastral registration of land system except as a technical, quantitative and qualitative function of land records and in addition to be a «constitutive function» is not correct» - summed up the view of participants of discussion Vladislav Kysil.
The Committee meeting was attended by over 10 representatives of the companies - members of Ukrainian Real Estate Club.
