Mechanism for an effective reform of State Architectural and Construction Inspection of Ukraine

It has been announced at the meeting of Law Committee of Ukrainian Real Estate Club (URE Club) by Vitalii Hrusevych, Executive Director of Confederation of Builders of Ukraine (ÑBU).

According to him, the most important things for optimizing the work of State Architectural and Construction Inspection of Ukraine (SACI) are these three:

-        to develop and approve new checklists for providing administrative services of obtaining permits for construction;
-        to reform responsibility of employees of SACI; all documents should be reviewed and signed by responsible executors specified in the checklists of the administrative service;
-        to transfer activities of SACI into automatic and public system.

«Today, State Architectural and Construction Inspection of Ukraine, contrary to the law and under the guise of providing purely administrative services, performs functions of construction control. It is being done at the stage of obtaining permits when there is nothing to control. Employees of SACI can have powers to control only after developer has received the right to construction, and not at the stage of obtaining permission to carry out construction works”, Vitalii Hrusevych said.  

«As for the procedure, CBU studied the existing approved checklist of the administrative service for obtaining permits to start construction works. But what did we see in it? Only 3 things: 1) Documents are taken 2) Documents are being considered 3) Decision is made», the expert said.

Vitalii Hrusevych said that «CBU developed proposals detailing the necessary procedure for issuing permits for construction works, from adoption of documents to revising in “Prozora DABI” (“Transparent SACI”) system by First Deputy of SACI if considering the application for issuing permits is well-timed».

Vladyslav Kysil, head of Law Committee of Ukrainian Real Estate Club (URE Club) noted that the Club is ready to take an active part in development of such checklists and proposals for optimizing the process of providing administrative services to SACI. At the same time, the expert drew attention to the fact that it is also important to conduct a comprehensive audit of authority of SACI; as a result, changes in the organizational structure of this institution are quite possible.  

«In recent years, SACI has become “Leviathan” that seeks to control too many things. At the same time, the institutional capacity to exercise this control is rather limited. What more can I say, if even in the head office there is no electronic document management system and the processes of providing administrative services are extremely flawed. The way out of the current situation is a significant reduction in powers of the state inspection and a change in its organizational structure», Vladyslav Kysil said.
