Legal Committee of URE Club participated in the preparation of the Draft Law of Ukraine On Regulation of Urban Development

On November 25th, 2010 the regular meeting of the Legal committee of URE Club took place. The agenda for discussion was as follows: expert section - Draft Law of Ukraine On Regulation of Urban Development; Regulatory Section - Problems of practical implementation of the Procedure for Registration of Title to the Land Plots, approved by Cabinet of Ministers of Ukraine dated May 6, 2009 N 439.

 

Following reviewing of the draft bill, Vladislav Kisil, chairman of the Legal Committee of URE Club, partner of KPD Consulting Law Firm, said: "the Committee reviewed the draft Law of Ukraine On Regulation of Urban Development, prepared by a working group on the initiative of Deputy Prime Minister Sergei Tigipko. Participants of the meeting, in general, approved the draft Law, as it dramatically simplifies the system of construction permits, introduces the declarative principle for obtaining permits and the principle of tacit consent for permit issuance. Simultaneously, a number of provisions of the draft, in particular those relating to land law, require improvement. Based on the discussions, the proposals of experts who participated in the meeting were sent to the working group".

 

Regulatory section was devoted to one of the most crucial problems associated with ignoring by the territorial bodies of the State Land Committee of the simplified procedure for the registration of the transfer of title to land plots(i.e. registration without the necessity to issue the State Land Act). Numerous violations of Article 126 of the Land Code of Ukraine, reported by participants of the Committee, take place in the activity of State Land Committee of Kyiv, Dnipropetrovsk, Kharkiv, Poltava and other areas. Officials illegally denied in registering the transfer of title, illegally forcing applicants to apply for the Land State Acts issuance. Following the discussions the petition was prepared and sent to State Land Committee with the demand to take immediate action to stop violations of the rights of landowners.

 

The meeting of the Legal Committee of URE Club was attended by representatives of developers, legal and consulting companies who are the members of Ukrainian Real Estate Club.
